  1. Applicability

1.1 These General Terms and Conditions apply to every offer and every agreement concluded between International Lied Festival Zeist and the person ordering/purchasing an admission ticket for International Lied Festival Zeist (hereinafter referred to as: the 'Visitor').
In these general terms and conditions, event means (musical) performances and/or other manifestations in the broadest sense of the word.

1.2 In these general conditions, the place where the event is held means the actual location of the event as well as all the grounds, spaces, fields etc. around it, which are part of the complex, within which the event takes place.

  1. Conclusion of the agreement/admission tickets

2.1 The agreement on attending an event between International Lied Festival Zeist and the Visitor is established when the Visitor orders/purchases an admission ticket for the event from International Lied Festival Zeist.
2.2 The admission ticket will be issued once.
2.3 The admission ticket entitles the holder to attend the event.
2.4 From the moment the admission ticket is made available to the Visitor, the Visitor shall bear the risk of loss, theft, damage or misuse of the admission ticket.
2.5 The International Song Festival Zeist cannot guarantee receipt of the admission ticket. If the visitor has not received an admission ticket, he will report this to the International Song Festival Zeist in good time before the Event. Timely means in time before the start of the Event so that the International Song Festival Zeist can invalidate the purchased admission ticket and issue a new one. If the admission ticket was purchased from the International Song Festival Zeist or an advance sales address, the visitor will receive a new admission ticket. The burden of proof that the visitor has purchased the admission ticket rests with the Visitor.
2.6 International Song Festival Zeist reserves the right to place a maximum on the number of tickets to be ordered, and the Visitor is then obliged to comply with the maximum set by International Song Festival Zeist.
2.7 Admission tickets cannot be returned. The provisions of Article 6:230p sub e of the Civil Code apply to admission tickets.

  1. Access

3.1 The holder of the admission ticket who first shows the admission ticket at the start of the Event will be granted admission. The International Song Festival Zeist assumes that this holder is also the entitled party.
3.2 An admission ticket does not entitle to access to (the relevant area in) the Building or Venue after the start or after the end of the relevant Event. In the case of a live stream, however, it may be possible to participate after the start of the Event. Afterwards, it is not possible to watch the performance back, unless this is explicitly stated.
3.3 A ticket allows the Visitor to watch a livestream performance once on one device. The livestream performance may only be watched in a domestic setting. Viewing in a larger organised setting is prohibited.
3.4 During their stay in the Building or Venue, the Visitor is obliged to behave in accordance with public order, good morals and the rules of decency (relating to the nature of the Event attended). The Visitor is also obliged to follow the house rules and instructions of officials of the International Song Festival Zeist recognisable as such.
3.5 If the Visitor violates these standards, house rules and/or instructions in any way, the Visitor may be denied (further) access to the Building or Venue, without the Visitor being entitled to reimbursement of his/her admission ticket and/or other costs.
3.6 Access in this case may be denied for an indefinite or definite period of time.

  1. Ban on resale etc. 

4.1 The Visitor is obliged to keep the admission ticket for an event for himself and therefore not to resell it, offer it for sale or offer or provide it in any way to third parties for commercial purposes.
4.2 A visitor who gives his admission ticket to a third party free of charge and not for commercial purposes is obliged to impose the obligations imposed on him as a visitor, as set out in these General Conditions for Visitors, on the person to whom he transfers the admission ticket. The Visitor guarantees to the International Song Festival Zeist that such third party/parties will comply with the obligations.
4.3 International Song Festival Zeist is entitled (but not obliged) to check the identity of the holder of the entry ticket to determine whether it matches the name of the Visitor, and if it does not match, to refuse the holder entry to the event.

  1. Other obligations of the Visitor

5.1 The Visitor must be in possession of a valid and undamaged admission ticket both before the start and during the event and for as long as he is at the place where the event is held. He is obliged to show his admission ticket at the request of authorised persons.
5.2 For the benefit of the performer(s) and fellow visitors, the Visitor is prohibited from making photo, video, film and sound recordings and/or using suitable equipment for this purpose during the Event without the permission of the International Song Festival Zeist. The Visitor is not permitted to reproduce, distribute or broadcast (any part of) the (livestream) performance in any form and by any means whatsoever, or to store it in a database or retrieval system. In case of violation, the Visitor may be denied (further) access to the Building or the Venue.
5.3 The Visitor may not promote their own organisation without prior written consent.
5.4 The Visitor is obliged to comply with the regulations (including house rules) and/or
instructions from International Song Festival Zeist, the operators of the venue where the event is held, the orderly personnel (security), the fire brigade and other authorised persons.
5.5 Within the Building or Venue, smoking is prohibited in respect of all (including electronic) smoking materials, with the exception of any designated smoking areas. An official of the Building or Venue has the right to deny the Visitor (further) access to the Building or Venue in the event of violation, without the Visitor being entitled to a refund of the admission ticket and/or other costs.

  1. Rights of International Song Festival Zeist

6.1 If a visitor breaches one or more of the provisions set out in these general conditions, International Song Festival Zeist will be entitled to invalidate the admission ticket or refuse the visitor (further) access to the event without the visitor being entitled to restitution of the amount he has paid to International Song Festival Zeist for the admission ticket (including service charges). Holders of invalidated entry tickets will not be entitled to a refund or compensation otherwise.
6.2 International Song Festival Zeist reserves the right to deny the Visitor (further) access to the event or to remove him/her from the place where the event takes place if International Song Festival Zeist reasonably considers this necessary to maintain peace and order during the event.
6.3 The International Song Festival Zeist has the right to make visual and/or sound recordings of the Event at which the Visitor is present, before, during and/or after the Event. The International Song Festival Zeist acts in accordance with the General Data Protection Regulation (AVG) by not recording the visitor in an identifiable manner. The basic principle here is that a person is identifiable if their identity can reasonably be established without disproportionate effort.

  1. Force majeure

7.1 In addition to article 6:75 of the Dutch Civil Code, the International Song Festival Zeist is not liable for damage suffered by the visitor, including refunds of admission tickets and/or other costs, as a result of force majeure on the part of the International Song Festival Zeist. Force majeure includes any circumstance beyond the control of the International Song Festival Zeist - even if it could have been foreseen at the time the agreement was concluded - that temporarily or permanently prevents compliance with the agreement, as well as, insofar as not already included therein, fire, strike, weather conditions, government-imposed measures to prevent the spread of disease, terrorist threats and disturbance.
7.2 In the event of force majeure, which in this context includes illness and/or cancellation of one or more of the performer(s), the International Song Festival Zeist has the right to replace the performer(s) in question with comparable other performers and, where necessary, to adjust the programme, or to postpone the Event to a later date, or to cancel the Event.
7.3 If an event is cancelled by International Lied Festival Zeist before it has begun as a result of or in relation to force majeure, International Lied Festival Zeist will only be required to refund to the visitor the fee stated on the entry ticket or, failing this, the fee (excluding service charges) paid by the visitor via the official advance sales address referred to in article 1.1. If, as a result of or in connection with force majeure, an event has to be cancelled after it has started, International Song Festival Zeist will only be required to refund a part of the fee stated on the entry ticket or, failing this, the fee (excluding service charges) paid by the visitor via the official advance sales address referred to in article 1.1. Refunds will be made only within twelve weeks of the cancelled date at the latest. Service charges or other damages will not be refunded.
7.4 If the Event is moved by the International Song Festival Zeist, the admission ticket will remain valid for the new date on which the Event will take place. The International Song Festival Zeist may also choose to issue new admission tickets for the Event in the event of relocation. In that case the previously issued admission tickets will expire. If the Visitor cannot or does not wish to attend the Event on the new date, he is entitled to return his admission ticket to the party from which the admission ticket was purchased and will receive a refund of the admission ticket and/or other costs. This refund will only be made if the Visitor presents a valid and undamaged Admission Ticket to the advance sales address within twelve weeks from the date on which the Event was due to take place. Service charges or other damage will never be reimbursed. Nor can the Visitor claim (replacement) admission to another Event.
7.5 The International Song Festival Zeist has the right to adjust the (regular) opening hours to accommodate occasional drills as part of the company emergency response or, in the event of a calamity, to evacuate the Building or Venue in whole or in part, without the Visitor being entitled to a refund of the admission ticket and/or other costs and/or compensation).

  1. Liability International Song Festival Zeist 

8.1 The Visitor's stay in the Building or Venue is entirely for his/her own account and risk. The International Song Festival Zeist is only liable for material and/or consequential damage or injury suffered by a visitor that is the direct and exclusive result of intent or gross negligence on the part of the International Song Festival Zeist and/or its officials. Only damage for which the International Song Festival Zeist is insured, or should have been insured in all reasonableness and fairness, will be eligible for compensation, and only up to the maximum insured amount or EUR 25,000 per event. If no payment is made under the insurance policy, for whatever reason, the liability of Internationaal Lied Festival Zeist will be limited to an amount of EUR 25,000 per event or series of related events.
8.2 The liability of the International Song Festival Zeist is excluded for, inter alia:
a. damage resulting from the actions of third parties, including persons engaged by the International Song Festival Zeist and tenants of (spaces in) the Building or Venue and persons engaged by these third parties;
b. damages resulting from failure to comply with instructions given by the officials of the International Song Festival Zeist and from failure to observe the generally applicable rules of decency;
c. (consequential) damages resulting from unforeseeable changes in the starting and closing times of the Events to which the agreement between the International Song Festival Zeist and the Visitor relates;
d. damage caused by other Visitors.
e. damage caused by loss of or damage to the admission ticket.

  1. Personal data

9.1 The Visitor's personal data, including data relating to the name, address, postal code, place of residence, telephone number, sex, date of birth and e-mail address of the Visitor, recorded by the International Song Festival Zeist in connection with the sale of an entry ticket, will be included in the administration of the International Song Festival Zeist and possibly provided to the relevant partner(s) at the Event. The purpose of these records is to manage and dispose of personal data for administrative operations, visitor registration analysis and mailings.
9.2 As a data subject, the Visitor may invoke the right to inspect, and/or unsubscribe from receiving mailings at any time. The International Song Festival Zeist processes personal data in accordance with applicable laws and regulations and in accordance with its privacy policy, which can be found on the website of the International Song Festival Zeist.

  1. Friends and patrons

10.1 Friends are registered via an application or authorisation form and pay an annual friends' contribution to be determined by International Song Festival Zeist. As of 2024, a friend contribution of €45.00 and for a friend with partner €70.00 will apply. Friends who do not give a mandate pay a surcharge of €5.00 for administration costs (contributions are then €50.00 and €75.00 respectively). Friends' contributions benefit the operation of International Song Festival Zeist.
10.2 Patrons commit through a periodic gift agreement to contributing at least €500.00 per year for a minimum of five years. Donations from patrons benefit the Next Generation Fund, which was set up to finance activities to develop young talent, such as the Young Artist Platform and the Masterclass.
10.3
Friends get priority at the start of ticket sales, receive 10% discounts on ticket purchases, receive invitations to special events, and can bring a guest to select recitals.
10.4
Patrons are additionally invited to the opening recital, the Young Artist Platform, the Masterclass and the presentation recital of the Masterclass.
10.5 The following provisions apply to friends:
a. Friendship is indefinite until resignation by the end of the year.
b. The starting point for payment is a direct debit authorisation.
c. When paying by bank transfer, a €5.00 surcharge is applied to the friends' contribution.
d. Direct debits take place annually at the end of January and friends who pay by bank receive a payment reminder and an authorisation form.
e. At the end of February, the friends pass with discount code will be sent to all registered friends who have paid in the previous year.
f. If a friend has not paid a friend fee for two consecutive years, they will be removed from the active friends file.

  1. Complaints

11.1 Complaints regarding the implementation of the agreement between the International Song Festival Zeist and the visitor must be submitted to the management of the International Song Festival Zeist within eight days after the implementation of the agreement has taken place or should have taken place. If complaints are submitted after this deadline, the management of the International Song Festival Zeist may decide not to deal with them.
11.2 Claims are not possible with regard to the following complaints and circumstances, and do not lead to any obligation for compensation on the part of International Song Festival Zeist:
a. changes in the programme, including and not limited to, changes in the person(s) of performers, in the composition of the programme, timing of the programme and shifting of Events to another date;
b. the quality of the performances of the Events to which the agreement between the International Song Festival Zeist and the Visitor relates;
c. nuisance or inconvenience caused by other Visitors or unlawful intruders including, and not limited to, noise nuisance, inappropriate behaviour, theft and vandalism; in the event of repeated nuisance or inconvenience by certain, to be identified Visitor(s), the International Song Festival Zeist will do everything possible to deny such Visitor(s) access in the future (if necessary);
d. nuisance or inconvenience caused by maintenance work on the Building or Place, and/or on the consequences of such maintenance work that could reasonably be carried out at that time;
e. nuisance or inconvenience caused by the improper functioning of facilities in the halls of the Building or Place;
f. nuisance or inconvenience, including limited visibility for the Visitor, caused by (sound) recordings by the media and the technical facilities in the halls made as a result thereof;
g. (noise) nuisance caused by simultaneously taking place Events, including necessary actions required for the preparation of these Events, or which are in any other way related to these Events, in other areas of the Building or the Venue;
h. the allocation and distribution of seats and/or a change in the seating plan necessitated by circumstances;
i. nuisance or inconvenience, including limited view of stage and/or surtitles;
j. the presence or absence of surtitles caused by the malfunctioning of the technical facilities, or the choice of the International Song Festival Zeist to provide such facilities or not;
k. nuisance or inconvenience caused by public transport strikes;
l. denial of access to an Event that has already begun.

  1. Final provisions

 

12.1 These general terms and conditions and any agreement existing between the Visitor and International Song Festival Zeist shall be governed by Dutch law.
12.2 All disputes that may arise as a result of the agreement between
International Song Festival Zeist and the Visitor or any agreement resulting therefrom shall be settled exclusively by the competent court in Amsterdam. International Song Festival Zeist is at all times authorised to designate another legally competent court.

privacy

The International Song Festival Zeist Foundation (ILFZ) is aware that you provide it with personal data. The foundation realises that you place your trust in it and sees it as its responsibility to handle your data with care. This privacy statement tells you what data we store about you, why and for what period of time.

what data do we process?

When you order tickets for one of our activities, we record (to the extent this data is required by the ticketing system):
- your first and last name
- how you wish to be addressed (Mr/Ms)
- your address details
- your phone number
- your email address
- for which activities you ordered tickets
- at which rate you ordered the tickets (normal/friendly/<30 yrs)

For the purpose of newsletters, we store only:
- your first and last name
- how you wish to be addressed (Mr/Ms)
- your email address
- and when you have completed this your place of residence.

If you are a friend or patron, we additionally register:

- Whether you became a friend alone or with a partner or as a patron;
- Whether you have authorised us to collect your annual donation;
- the bank account number for which you have issued an authorisation;
- the gift agreement for the recipient when you make use of it;
- The amount of your annual donation.

for what purpose do we record this data?

The personal data mentioned above are processed to:
- handle your order and send you admission tickets by e-mail;
- to send you our newsletter and/or other information material;
- be able to contact you if necessary to perform our services;
- To be able to inform you of changes to our services and products;
- maintain an up-to-date friends and patrons database;
- to collect your annual friends' contribution and patronage fee.

how long do we keep your data?

We do not retain your personal data for longer than is necessary to fulfil the purposes for which it was collected. When you no longer place orders for a period of up to five consecutive years, we will delete the data collected for the purpose of ticket sales from our files.

If you have not paid any more friends' contributions for a period of up to five consecutive years, we delete the data collected for the purpose of our friends' administration from our files. We keep donation agreements for the 7 years prescribed by the tax authorities.

For the newsletters, you can unsubscribe at any time by using the link in the footer. However, your data will then be retained. If you wish to be permanently removed from the mailing list, please send an e-mail to info@ilfz.nlwith your request.

do we share your data with third parties?

We only provide your data to third parties if there is a legal obligation to do so. We conclude a processing agreement with organisations that process your data on our behalf to ensure the same level of security and confidentiality of your data. The International Song Festival Zeist remains responsible for this processing. We do not transfer your data outside the EU.

We take appropriate measures to counter abuse, loss, unauthorised access, and other unwanted actions with personal data.

rights of data subjects

You have the right to access, correct or delete your personal data. You also have the right to withdraw your consent to data processing or object to the processing of your personal data by International Song Festival Zeist.

Address an objection or request preferably via e-mail to our secretary. Contact details can be found at the bottom of this page. We will respond to your request as soon as possible, but at the latest within four weeks. To make sure that the request comes from you, we ask you to send a copy of a valid identity document. In this copy, only your name and initials need to remain legible. All other personal information (BSN, passport photo, passport number, etc.) may be rendered illegible to protect your privacy.

You can lodge a complaint about our protection of your personal data with the courts. You thereby invoke the legal protection offered to you by the Personal Data Protection Act.
